BCDA vs CJHDEvCo Feud - The Winners and the Losers

After a decade or so of legal arguments and debates the BCDA vs. CJHDevCo legal feud has finally met its end. From ta win-win situation for both parties at the onset, a dramatic turn of events led to a decision favoring the CJHDevCo and the Camp John Hay homeowners and investors.

The Court of Appeal has recently rendered its decision. It granted the petition of CJHDevvCo (the land developer) until the Bases Conversion and Development Authority (BCDA) return the 1.4 B pesos covering back rentals it owed the Sobrepenas. For now, CJHDevCo has still control of the leased properties inside Camp John Hay.

Let us go into details to find out who are the winners and who are the losers.

THE WINNERS:

Camp John Hay Development Corp.

The Sobrepena owned Camp John Hay Development Corp. (CJHDevco) for the court so ordered that the developer to stay in Camp John Hay until it is paid the P1.4 billion awarded to it by an arbitration panel in February.

Camp John Hay Homeowners and Investors

These people can now have a sigh of relief for the Court of Appeals (CA) in its recent ruling on permanently stopped a Baguio court from evicting homeowners and business establishments inside Camp John Hay.

Furthermore, the Court of Appeal confirms third party homeowners are buyers in good faith and not a party to the arbitration. Another welcome rejoinder met with jubilation by the said investors and property owners. Their properties are well-secured now from BCDA's threats. they too have all the time to enjoy to the fullest all the amenities, Camp John Hay has to offer.

City of Baguio

To me, the big winner here is the City of Baguio. With the decision, the city government can set their CJH plans to full blast. This can start a new era in terms of betterment of life for the people of Baguio. The economy will soon rise and tourism programs will reach new highs.

THE LOSERS:

BCDA and Arnel Casanova

Casanova and his lieutenants at BCDA has no other recourse but to honor the court's decision. It is high-time that Casanova put his act together on where to find that elusive 1.4 B. Appealing the ruling in the Supreme Court may just be an exercise in futility.

President Benigno Aquino III

If only he had relieved Casanova of his post, then perhaps a fair settlement has been presented by whoever takes Casanova's post. But, PNoy stick it out with Casanova and that move has resulted in a tainted political legacy he is about to leave for his bosses to remember.

It is not too late though, the President has still a few months left in his tenure to rectify whatever blunders his 'good boys' have committed that include the Bully Arnel Casanova.
