Camp John Hay Issue - Finally Resolved

After a year or so of legal battle, a decision was finally served!

On February 11 2015, the Arbitration tribunal issued its Award in the arbitration between Bases Conversion and Development Authority (BCDA) and Camp John Hay Development Corporation (CJHDevCo).

In the Award, the Philippine Dispute Resolution Center, Inc., (PDRCI) has ordered BCDA to pay CJHDevCo Php1.42 Billion, representing rental payments made by the Sobprepena group to BCDA since 1996. In return, CJHDevCo was ordered to turn over the leased property to the BCDA with all improvements that CJHDevCO had made therein during the term of the lease.

In another development, the arbitration committee denied BCDA’s claim for 3.3 B pesos in back rentals from CJHDevCo. As such, this puts CJHDevCo free and clear of any liabilities to BCDA.

The decision was met with jubilation by both parties.

Arnel Paciano D. Casanova, BCDA president and CEO, deemed the tribunal's decision as a victory for the government. If and when returned to the BCDA, the leased property can be developed further where public interest is a prime concern.

CJHDevCo on their part, are happy and will respect the court's decision. Their only concern is the trees that they have planted. CJHDevCo hope that Bases Conversion Development Authority (BCDA) will take care of the 480,000 trees we will leave behind. There were 250,000 pine trees in the Camp When they took over the Camp in 1996. It has always been CJHDevCo position that the trees in John Hay are the Camp’s most prized assets.

They also assure the tenants that their rights to the properties they acquired and are now used in John Hay will continue to be protected and respected.

In the meantime, CJHDevCo will abide by the Arbitral Award and will cooperate with BCDA for a peaceful transition provided that the award is confirmed by the Regional Trial Court of Baguio City and the payment of 1.42B pesos has been received in full by CJHDevCo.

The question now is, when will the BCDA produced the money to pay CJHDevCo? Until such time that the payment is made, CJHDevCo will still be in control of Camp John Hay; and it is a welcome development for them.
